Terms & Conditions
Booking dates will be held once 50% deposit has been processed and final payment due has 30 days prior to event date. However, if final payment is not received by California Flower Walls 30 days prior to client scheduled and booked event by date. Clients booked/scheduled event date will be released due to non-payment.
1. Deposit & Payment : 50% Non-Refundable Deposit Due to Reserve Date.
2. Cancellations, Scheduling, Set Up & Breakdown:
Two weeks prior to event set up & Break down time is determined and confirmed.
One week prior to event, details will be reconfirmed. If set up or pick up is delayed or changed for for any reason by client, their venue, or contracting party within the two week time frame rental is subject to availability and there is a $15 charge for every 30 minutes of delay to set up or pick up.
Rush Fee: For bookings within seven (7) days of an event, a rush fee will be added. 7-5 days from the day of the event an additional 10% surcharge will be added to the invoice, 2-4 days 30% surcharge will be added, within 48 hours an 50% surcharge will added.
Backdrops take at least an hour to set up (this does not include unloading time) and 30 minutes to breakdown. Please allow ample time for access to venue & schedule accordingly. California Flower Walls is not responsible should incorrect timing be given to the venue to properly set up and secure the backdrops or pick them up at the end of booking.
The client, venue or contracting party is responsible for providing parking and providing reasonable accommodations to load and unload.
Setup and Breakdown is to be provided soley by California Flower Walls to ensure they are properly put together and no damage occurs. Some assistance may be required by the contracting party.
This rental agreement, governs clients use of and participation in California Flower Wall rentals. By accepting it electronically or otherwise, you, or the “Client”, agree that you’ll rent the equipment enumerated within the separate contract invoice that we provide you per that Document’s terms and this Agreement’s conditions, including:
THIS TERMS OF SERVICE AGREEMENT (“AGREEMENT”) GOVERNS CLIENT'S USE OF AND PARTICIPATION IN ANY RENTALS OR USE OF THE SERVICES. CAPITALIZED TERMS HAVE THE DEFINITIONS SET FORTH HEREIN. BY ACCEPTING THIS AGREEMENT, BY (1) CLICKING THE BOOK NOW BOX INDICATING ACCEPTANCE, AND/OR (2) ACKNOWLEDGING ACCEPTANCE OF THIS AGREEMENT IN A SEPARATE DOCUMENT REFERENCING OR INCORPORATING THE TERMS OF THIS AGREEMENT THROUGH PAYMENT, CLIENT AGREES TO THE TERMS OF THIS AGREEMENT. IF THE INDIVIDUAL ACCEPTING THIS AGREEMENT IS ACCEPTING ON BEHALF OF A COMPANY OR OTHER LEGAL ENTITY, SUCH INDIVIDUAL REPRESENTS THAT THEY HAVE THE AUTHORITY TO BIND SUCH ENTITY AND ITS AFFILIATES TO THESE TERMS AND CONDITIONS, IN WHICH CASE THE TERM “CLIENT” SHALL REFER TO SUCH ENTITY AND ITS AFFILIATES. IF THE INDIVIDUAL ACCEPTING THIS AGREEMENT DOES NOT HAVE SUCH AUTHORITY, OR DOES NOT AGREE WITH THESE TERMS AND CONDITIONS, SUCH INDIVIDUAL MUST NOT ACCEPT THIS AGREEMENT AND MAY NOT USE THE RENTAL SERVICES. This Agreement was last updated on July 22, 2023. It is effective between Client and California Flower Walls (“California Flower Walls”) as of the date of Client's accepting this Agreement.
Upon receiving a delivery, client, or your duly authorized agent must verify it in person. Client agrees to sign off with a California Flower Walls staff member acknowledging your receipt of the delivery and assumption of responsibility for the equipment.
If you receive equipment in a damaged or otherwise unusable state, you agree that you’ll provide California Flower Walls with a text or telephone notification before your event commences. You also waive your right to seek refunds or any other credits for such rentals if you fail to notify California Flower Walls of the problems in writing before the event. You acknowledge that California Flower Walls won’t accept order modifications or equipment exchange requests after our delivery representatives have vacated the drop-off location and or event has commenced.
ACCEPTABLE RENTAL USAGE
You agree not to sublease, rent out, or otherwise attempt to loan for remuneration any equipment rented from California Flower Walls.
ORDERS AND CHANGES
All order/rental changes must be placed in writing or emailed to avoid any confusion. A detailed invoice will be submitted following any changes to your original order by email. Additional service requests require an appropriate deposit and will be charged to your credit card unless other terms are specified. Emails are considered legal and binding and do not require a signature to be valid. If changes are made the day of the event , the client must sign for them upon delivery, pay with cash, or credit card will be billed automatically. Substitutions are allowed with a 14 day notice. No substitutions are allowed within 14 days of the event. However, items may be allowed for substitution based on availability and at the discretion of California Flower Walls.
Please be aware that once the contract is signed, and your event date scheduled, all other clients have been refused your specific rentals and services for your event date and time, and thus all payments are non-refundable within 30 days of your event.
We allow 75% refund up to 8 weeks prior to your event date.
We allow 100% refund within 24 hours of booking.
All services may be canceled if received in writing via paper or email no later than 4 weeks prior to the event. A credit in the amount of the deposit will remain on file if the event is postponed.
You would not be obligated to pay the balance of your invoice, unless you placed a customer order which was designed specifically for your event. In such cases, you would be contractually bound to pay the balance of your invoice, unless you placed a custom order which was designed specifically for your event. In such cases, you would be contractually bound to pay the balance due on the account.
No services contained in this contract will be rendered, delivered, or available if balance is not paid in full prior to your event.
No payments will be accepted beyond the event date. No exceptions!
If payment is not received in a timely manner, California Flower Walls will consider your rented items and services available for another client’s use. California Flower Walls is not contractually obligated to accept payments beyond the due date, nor refund previous payments. We will schedule another client’s event on your event date if we have been unsuccessful in contacting you or obtaining a response from you regarding payment. We will attempt to contact you using all phone numbers and email addresses. You will not receive a notice in the mail. We understand that some things happen which are out of your control and we will work with you if you experience difficulty. It is possible to modify your contract, but must be approved by California Flower Walls. Communicate with us! We do not want to stress you out!
YOUR RESPONSIBILITIES CONCERNING DAMAGED EQUIPMENT
During the rental period, you agree that you’ll cease using the equipment as soon as it becomes unsafe or you observe it in a state of disrepair. You’ll notify California Flower Walls of the hazard immediately and continue taking reasonable steps to prevent persons and properties from sustaining injury or damage until our representatives personally relieve you of responsibility for the items.
LOSS, DAMAGE, AND DESTRUCTION FEES
If any equipment suffers damage, loss, or destruction, you agree to pay California Flower Walls the entirety of the necessary costs to replace it at retail value. See values below:
Flower Walls – $4000 each
Hedge Walls – $2000 each
Other Backdrops – $1250 each
Wall Stands/Bases – $500 per set
Neon Signs – $1000
Damages and repairs – Starting at $500 (or more depending on severity of damages and repairs)
Note: California Flower Walls may let you pay the repair expenses for compromised goods at our sole discretion if we deem it possible and practical to restore them to their original pre-rental state.
We reserve the right to charge service fees for each occurrence of damage, including intentional modifications such as stapling, gluing, or nailing. We’ll also bill you for any items that require excessive cleaning.
Credit Card Terms
A valid credit card must be kept on file. The credit card will be used for damages, missing items, late fees, replacement fees, cleaning fees, or added services if requested and approved by the client.
Credit Card Payment
Payments can be made online via online email or text sent to client by California Flower Walls.
50% Deposit is due at booking. The remaining final payment is due 30 days prior to your event.
At the end of the rental period, you must return all of the equipment in a state identical to how you originally got it. You agree not to disassemble any backdrop rentals such as flower walls, hedge walls, or any backdrop stands.
Balloons are not considered rentals and may be disposed of at the end of the event. California Flower Walls is not responsible for the teardown of balloons unless originally agreed upon. If you would like a California Flower Walls team member to return and teardown the balloons, an additional fee will be applied and this must be requested no later than 48 hours in advance of the event commencement date.
In the event that there is damaged or missing equipment, California Flower Walls will contact you within no more than two business days following the pick-up date. If you can’t locate missing equipment within 24-hours of receiving such notice, you authorize us to automatically process a payment to the credit card or payment method provided.
Limitation of Liability
The Client acknowledges and agrees that California Flower Walls will not be liable for any losses or damages, whether indirect, incidental, special or consequential, in profits, goods or services, irrespective of whether or not the Client has been advised or otherwise might have anticipated the possibility of such loss or damage.
The client acknowledges and agrees that California Flower Walls cannot guarantee the results or effectiveness of any of the services rendered or to be rendered. Rather, services shall be executed in a professional manner and in accordance with good industry practice. Best efforts will be used but no results are promised.
If claims for damages, injury, or loss arise concerning the equipment, its use, transportation, keeping, malfunction, or loading, you agree to indemnify California Flower Walls. You also acknowledge that you’re solely liable for any charges related to such claims or contract terms, including collection fees, attorney or court costs, and expenses that California Flower Walls incurs while enforcing this Agreement.
By accepting this Agreement, you consent to it’s terms and conditions in full, and you acknowledge that they pertain to all California Flower Walls invoices regardless whether such documents include their own terms.
California Flower Walls, LLC shall be excused from any delay or failure in performance required hereunder if caused by reason of any occurrence or contingency beyond reasonable control, including, but not limited to acts of God, acts of war, fire, insurrection, strikes, lock-out or other serious labor disputes, riots, earthquakes, floods, explosions or other acts of nature.
***** California Flower Walls equipment are for indoor and outdoor use, but are not made to withstand inclement weather. Should bad weather or wind become an issue, we may have to make the difficult decision to deny outdoor placement for safety reasons. California Flower Walls and staff have final approval on all prop placement. Backdrops must be placed on an even and flat surface for stability. We recommend placing near a wall to protect against the wind and to stabilize. Should equipment be blown over by wind or uneven ground, additional time and resources required to reconstruct will be subject to availability. WE ARE NOT RESPONSIBLE SHOULD EQUIPMENT BE UNSTABLE DUE TO UNFAVORABLE CONDITIONS OR BLOWS/FALLS OVER AFTER SETUP ****
There is an additional fee for outdoor rental setup. If using an outdoor setup, the client must inform California California Walls at time of booking.
TERMS AND CONDITIONS
This Rental Agreement (the “Agreement”) is a binding legal agreement between you (the “Client”) and California Flower Walls, LLC (“California Flower Walls”).
By accepting the Rental Agreement, you agree to be bound by the terms of this Agreement.
If you do not agree to the Rental Agreement, select, you will not be able to complete this form. Accepting the Rental Agreement signifies that you have read, understood, and agreed to be bound by the Agreement. We reserve the right to alter this agreement at any time, for any reason, without notice.
